Terms and Conditions

Scope of Application

The following Terms and Conditions govern the business and contractual relationships between Dietmar Näser Grüne Brücke – Office for Regenerative Agriculture – hereinafter referred to as the "Education Provider" – and the participants of training programs, seminars, events, field days, and workshops – hereinafter referred to as the "Customer."
Deviating or supplementary terms and conditions of the Customer shall not become part of the contract unless expressly agreed upon in writing by the Education Provider. Side agreements, amendments, or supplements to the contract must be made in writing to be valid, including the cancellation of the requirement for written form.

Subject Matter of the Contract / Conclusion of Contract

The subject of the contract includes the training services, field days, workshops, seminars, and courses (educational offerings) as described in the Education Provider’s current offers. All events follow the scope and content as specified in the respective offer, subject to necessary changes for organizational, methodological, or content-related reasons, or due to government-imposed contact restrictions, provided that the overall character of the event is not significantly altered. The Customer has no right to select a specific instructor or event leader.
The subject of the respective agreement is the implementation of the booked event or other agreed services, not the achievement of a specific success.
Unless otherwise stated in the event announcement, registration must be completed no later than three weeks before the event starts. Registration must be submitted in writing by post, email, or via the designated registration form on the website and only becomes legally binding upon written confirmation by the Education Provider.
Registration is binding for the Customer. With the registration, the Customer accepts the terms of participation, payment, and these Terms and Conditions.
The Education Provider reserves the right to make the implementation of the educational offerings dependent on a minimum number of participants. If the minimum number is not met and the event is cancelled, participants will be informed before the scheduled start of the event. There is no entitlement to the implementation of the event. Travel, accommodation, or work absence costs will not be reimbursed unless incurred due to gross negligence or intent on the part of the Education Provider. Fees already paid will be refunded.
If participation is limited to a maximum number of participants, registrations will be considered in the order of their date and time of receipt. There is no right to participate once the maximum number has been reached.
If a seminar explicitly requires the achievement of a qualification, this is only possible if the Customer attends the entire event.
Partial bookings with discounts are generally not possible unless expressly stated in the event program.

Prices and Payment Terms

The prices from the current price list at the time of registration apply. Participation fees include the net cost of the booked event and specified event materials. Costs for accommodation and meals are not included unless otherwise stated in the service description. If meals are offered by a local provider at the event location, the agreed costs are to be paid on site.
All participation fees are due before the start of the event. Payment must be made after confirmation of registration and invoicing by the agreed payment method, but no later than 14 days, to the indicated account. No deductions are permitted. Early payment discounts (Skonto) are not allowed. Participation is only possible after timely payment.

Event Process, Cancellations, Postponements

The Education Provider may cancel or postpone events for reasons beyond its control, particularly in cases of insufficient registrations, illness of instructors, or unavailability of the venue. The Customer will be informed promptly in writing. In the event of illness of an instructor and no replacement can be arranged in time, the Education Provider may postpone the event. If an event is cancelled without a replacement, any fees already paid will be refunded. The Customer shall have no further claims, particularly not for damages.
If the Customer misses all or part of an event, there is no entitlement to compensation or refund.
The Education Provider reserves the right to exclude participants who disrupt the event and fail to cease doing so after a warning. In such cases, there will be no refund.

Withdrawal, Cancellation Fees, Rebooking

If the Customer needs to cancel an event, cancellation is only possible before the start of the event and must be submitted in writing by post, fax, or email. The postmark date applies.

The following cancellation fees apply:

  • Cancellation up to 14 days before the event: €15 administrative fee. (This fee is waived if the Customer books another paid event in the same calendar year – rebooking.)
  • Cancellation between 8 and 13 days before the event: 50% of the event fee plus VAT.
  • Cancellation within 7 days before the event: 100% of the event fee plus VAT.

Instead of cancelling, the Customer may name a replacement participant who is subject to the same conditions. An administrative fee of €15 applies.
A change of instructor or event leader does not entitle the Customer to withdraw.
Cancellation fees will be offset against any payments already made.
Meal costs agreed with local providers must be paid in full if cancellation occurs within 24 hours or the participant does not attend.

Right of Withdrawal for Consumers (Distance Contracts)

Consumers have a statutory right of withdrawal for distance contracts (contracts concluded exclusively via distance communication). A consumer as defined in §13 BGB is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

Withdrawal Policy

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period for services (e.g., seminars) is fourteen days from the date of contract conclusion.
To exercise your right of withdrawal, you must notify us – Grüne Brücke – Regenerative Agriculture, Owner: Dietmar Näser, Talstraße 57, D-01844 Neustadt in Sachsen, Tel: +49 3596/5073826 or 5073458, Email: kontakt@gruenebruecke.de – by means of a clear declaration (e.g., a letter sent by post or email).
To meet the withdrawal deadline, it is sufficient to send your notice before the end of the withdrawal period.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than fourteen days from the day we receive your notice of withdrawal. Refunds will be made to your bank account, and no fees will be charged for the reimbursement.
If you requested services to begin during the withdrawal period, you must pay us an amount proportional to the services provided up to the point you notified us of your withdrawal.

Liability

The Education Provider is only liable for personal injury or property damage arising during events in cases of intent or gross negligence by the Education Provider or its agents.
There is no insurance coverage for items brought by the Customer. The Customer is responsible for lost or stolen items and is advised to obtain appropriate insurance.
Events are carefully prepared and conducted by the instructors and leaders. The Education Provider assumes no liability for the up-to-dateness, accuracy, quality, or completeness of materials or execution of the event.

Copyright

All event materials handed out during educational offerings are subject to copyright. The Education Provider reserves all rights to documents, results, and materials prepared by itself or its instructors. Reproduction, translation, reprinting, electronic processing, distribution, or publication is not permitted. This includes publication online or on social media.
The recording and sharing of any part of the event in audio, video, or digital form is strictly prohibited.

Data Protection

Customer data is processed electronically for internal purposes. All data associated with registration is stored in compliance with data protection laws.
The Education Provider processes personal data in accordance with the General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG), and other applicable regulations, for the following purposes:

  • Contacting participants
  • Organizing the educational offerings
  • Invoicing
  • Issuing certificates of participation
  • Providing information on upcoming courses and events

By registering, the participant agrees to the creation and publication of photo and video recordings during events by the Education Provider:

  • For documentation purposes
  • For creation of training materials
  • For advertising and press/social media/website/printed material
  • Further details can be found in the Education Provider’s privacy policy.

Miscellaneous

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected.
If the Customer is a registered merchant, a legal entity under public law, or has no permanent residence in Germany, the place of jurisdiction for disputes arising from or in connection with this contract shall be the district court of Pirna.
The place of performance is Neustadt in Sachsen.
Only German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
